Purpose of the Policy
BIXI Montréal (“BIXI“, “we“, “us“, “our“) is committed to protecting your personal information.
The purpose of our Privacy Policy (the “Policy“) is to explain how we collect, use and disclose your personal information when you use or browse our website https://www.bixi.com (the “Site“), when you use the features of our BIXI MOBILE application (the “Application”) or when you use our BIXI self-service bicycle and bicycle trailer system (the “Service”). By browsing the Site or using the Application, you confirm your acceptance of this Policy. If you do not agree to this Policy, please do not browse the Site or use the App.
The Site and the App may include hyperlinks to websites, content, resources, advertisements, products, or services owned or operated by third parties (the “External Resources”). This Policy does not apply to the collection, use, or disclosure of your personal information by these third parties, and BIXI is not responsible for such practices. If you visit an External Resource, we encourage you to review that third party’s privacy policy.
What personal information do we collect and how do we collect it?
BIXI collects and has access to your personal information in various ways, depending on your use of the Website, the Application, and the Service. You may choose not to provide certain personal information, but you may then not be able to take advantage of certain features of the Website or the Application or use the Service.
a) When you browse the Site or use the Application, we collect information related to your devices, such as your IP address (see the section of this Policy entitled “What do we use cookies for?”).
b) When you create a user account, we collect certain personal information directly from you, including your name, email address, phone number, date of birth, and gender.
c) If you purchase a monthly or seasonal membership to the Service, we collect additional personal information directly from you, such as your residential address. When you purchase a membership to the Service or make any other transaction through the Site or the Application, our online payment service providers also collect certain additional information, such as payment data (e.g., payment card number, CVV code, and expiration date). We do not have access to this information, which is encrypted and used by online payment service providers in accordance with PCI-DSS standards.
d) If you enable the geolocation feature on your mobile device, which can be activated when downloading the Application or subsequently via your mobile device settings, we also collect geolocation data, such as your geographic location, in order to inform you of terminals located near you. If you disable the geolocation feature on your mobile device, you will not be able to access the Service.
e) If you use the Service, we also collect data about your use of BIXI bikes and bike trailers, such as the routes you take and the rental status of bikes or bike trailers, and we have access to your account billing information.
f) In addition, if you contact us for any reason or subscribe to our newsletters, we collect the personal information you choose to provide us at that time.
Where possible, we obtain your personal information directly from you. However, we may collect or access your personal information from third parties when you consent to it or when permitted by law.
What do we use your personal information for?
We use your personal information primarily to:
- Provide you with the Service and features of the Site and Application, including locating BIXI stations, bikes, and bike trailers;
- Identify your location in order to provide you with the Service;
- Monitor, maintain, and prevent theft of BIXI bikes and bike trailers;
- Improve the quality of the Service, the Site, the Application, or their features;
- Create your user account and keep it active (to allow you to carry out transactions and subscribe to memberships, if applicable, as well as to keep a record of your trips);
- Process payments for memberships to the Service or other transactions made through the Site or the Application;
- Communicate with you about your user account and provide you with customer service when necessary;
- Verify your compliance with the Service or the Application’s features;
- When you have consented, send you our newsletters;
- Communicate with you following a message or request from you and respond to it;
- Deliver targeted and personalized advertising; and
- Any other purpose that we identify from time to time and that is permitted by law or for which we obtain your specific consent.
What do we use cookies for?
When you browse the Site or use the Application, we collect certain information through cookies and other tracking technologies (collectively, “cookies“).
The cookies we use do not collect personally identifiable information, but rather general information that we do not combine with your personal information. Specifically, we use the following cookies:
a) Essential cookies: These cookies are essential for the Site and Application to function and cannot be disabled in our systems. These cookies must be present for the Site and Application to provide basic functions, such as logging in.
b) Functional cookies: These cookies allow us to offer enhanced functionality and personalization. These cookies allow the Site and Application to remember the preferences and choices you make (e.g., your language preference). You can disable these cookies by changing your browser or mobile device settings. However, if you refuse these cookies, your browsing of the Site or use of the Application may be affected.
c) Analytical cookies: We use Google Analytics and Hotjar to collect information about your use of the Site or the Application (e.g., the pages you visit most often and any error messages you may receive). This information is anonymous and we use it solely for statistical purposes and to improve the efficiency and functionality of the Site and the Application. You can disable these cookies by downloading this module (in the case of Google Analytics) and visiting this page (in the case of Hotjar).
d) Social media cookies: If you have consented to this, we use social media cookies, such as Facebook pixels, to provide you with personalized offers, measure and optimize advertising campaigns on social media platforms, and create audiences for this purpose. We also use cookies that enable us to add social media content sharing features to the Site and Application, including Facebook. Using the share buttons will install a cookie that links the content viewed on the Site or Application to your user account on these networks. To disable these cookies, please refer to the cookie policy of the relevant social networks (in the case of the Meta pixel on Facebook: Cookie Policy)
e) Advertising cookies: If you have consented to this, we use advertising cookies, including those from Meta, Google Ads, and TikTok Ads, to collect information about your devices in order to show you advertisements based on topics that interest you. Our partners may also use them to determine whether your advertisements have been viewed or whether you have interacted with them, and share data with us, including statistics on their performance. These cookies can be managed or disabled through your browser’s cookie settings and your mobile device’s advertising settings.

Who do we share your personal information with?
Only BIXI employees whose duties require it, its partners, and its service providers (e.g., hosting service providers, online payment service providers, or newsletter service providers) have access to your personal information collected by BIXI in connection with your use of the Site, the Application, or the Service, to the extent that such access is required for the purposes set out in this Policy. BIXI may also make your personal information available to other third parties in accordance with the application of a law or court order, or in the event that BIXI suspects criminal or illegal activity, such as fraud. BIXI may also disclose your personal information to third parties if necessary to protect its assets or enforce its rights, including for the collection of a debt.
Is your personal information transferred outside of Quebec?
The personal information collected by BIXI is stored on secure servers that may be located outside of Quebec, including elsewhere in Canada and in the United States. The same applies to the servers of its online payment service providers. Laws relating to the processing of personal information may differ in these jurisdictions. However, BIXI requires its partners and service providers to commit to protecting personal information, as indicated in the section “How do we protect the confidentiality of your personal information“?
How long do we keep your personal information?
Unless otherwise permitted by applicable law, BIXI only keeps your personal information for as long as necessary for the purposes set out in this Policy and to comply with its legal obligations. Therefore, the length of time your personal information is kept will vary depending on the purpose for which it was collected and used. After this period, your personal information will be securely destroyed or permanently anonymized. BIXI may use this anonymized data for serious and legitimate purposes without further notice or consent.
How do we protect the privacy of your personal information?
The personal information we collect or have access to is kept confidential in accordance with applicable privacy laws. Reasonable administrative, technical, and physical measures are implemented by BIXI to protect your personal information from accidental loss, theft, and unauthorized access, disclosure, copying, use, or modification. BIXI also implements contractual protections with its partners and service providers, under which they are required to implement and maintain reasonable administrative, technical, and physical security measures to preserve the security and confidentiality of personal information collected under this Policy.
What are your rights?
Under applicable law, you have certain rights, such as the following:
- The right to request access to your personal information;
- The right to request the correction of your personal information that is inaccurate or incomplete;
- The right to withdraw your consent to the disclosure or use of your personal information, in certain circumstances; and
- The right to obtain, in a structured and commonly used technological format, your personal information that you have provided to us or to request that it be transmitted to another person or organization in the same format.

How do we update our Policy?
BIXI updates this Policy from time to time. Notices of updates may be used to notify you of recent changes to this Policy, but posting the updated Policy on the Site or Application will be deemed sufficient notice. By continuing to browse the Site or use the App, you agree to the updated Policy.
In the event of any discrepancy between the French and English versions of this policy, the French version shall prevail.
